These Terms of Service ("Terms") govern your use of the Services provided by Startingline HQ, LLC ("we," "us," or "our"). By accessing or using our Services, you agree to be bound by these Terms.
By creating an account or using any of our Services (startinglinehq.com, EstatePal, DivvyDup, ScriptToggle), you represent that you are at least 18 years of age, you have the legal capacity to enter into a binding agreement, and you agree to comply with these Terms.
If you do not agree to these Terms, you may not use our Services.

Additional products may be added over time. These Terms apply to all current and future Services unless otherwise specified.
To use the Services, you must provide accurate, current, and complete information; maintain and update your information as needed; be at least 18 years old; and create only one account per person.
You are responsible for maintaining the confidentiality of your password, all activities that occur under your account, and notifying us immediately of any unauthorized access at hello@startinglinehq.com.
We are not liable for any loss or damage arising from your failure to protect your account credentials.
You may not share your account with others. Each user must have their own individual account.
Our Services are offered on a subscription basis. Current pricing is displayed on each product's landing page.
Payments are processed by Stripe, Inc. By subscribing, you authorize us to charge your payment method on a recurring basis.
You may cancel your subscription at any time through the Stripe Customer Portal accessible from your account settings. Cancellation takes effect at the end of your current billing period. You will retain access until that date.
No refunds are provided for subscription fees. We may issue refunds at our sole discretion for billing errors, duplicate charges, or technical issues preventing access for an extended period. Refund requests must be submitted to hello@startinglinehq.com within 30 days of the charge.
We reserve the right to change subscription prices. You will be notified at least 30 days in advance via email. Continued use after a price change constitutes acceptance of the new price.

You retain ownership of all data you enter into the Services ("Your Content"). By using the Services, you grant us a limited license to store, process, and display Your Content solely to provide the Services to you. You are responsible for the accuracy and legality of Your Content and for maintaining backups of important data.
The Services, including all software, design, text, graphics, logos, and trademarks, are owned by Startingline HQ, LLC and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes in accordance with these Terms.
We strive to maintain high availability but do not guarantee uninterrupted access. The Services may be temporarily unavailable due to scheduled maintenance, emergency repairs, or factors beyond our control. We reserve the right to modify, suspend, or discontinue any part of the Services with reasonable notice to you via email.
The Services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
Important for EstatePal Users: EstatePal provides organizational tools and templates but does NOT provide legal advice. The Services are not a substitute for consultation with a qualified attorney. We make no representations about the legal validity or enforceability of any documents created using our tools. You are solely responsible for consulting with appropriate professionals and ensuring your estate plans comply with applicable laws.
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of data, or legal issues arising from use of our tools.
Our total liability to you for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid us in the 12 months preceding the claim.
You agree to indemnify, defend, and hold harmless Startingline HQ, LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your Content.
You may cancel your subscription and delete your account at any time. We reserve the right to suspend or terminate your account immediately if you violate these Terms, engage in fraudulent or illegal activity, or your account poses a security risk.
Upon termination, your access ceases immediately, your data is retained for 30 days then permanently deleted, and you remain responsible for any charges incurred before termination.
When you cancel your subscription, your data is retained for 30 days to allow for reactivation. After 30 days, all data is permanently deleted and cannot be recovered. Billing records and transaction history are retained for tax and legal compliance, typically for 7 years. We strongly recommend exporting any important data before canceling.
Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any legal action arising out of these Terms shall be brought exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.
Before filing a lawsuit, you agree to first contact us at hello@startinglinehq.com to attempt to resolve the dispute informally.
We may modify these Terms at any time. When we make material changes, we will update the "Last Updated" date, notify you via email at least 30 days before changes take effect, and post the updated Terms on this page. Your continued use of the Services after changes take effect constitutes acceptance.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Startingline HQ, LLC regarding the Services and supersede all prior agreements.
You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms to any successor or affiliate without restriction.
By using our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
